IMPORTANT NOTICE TO THE CONSUMER

YOU HAVE THE RIGHT TO CANCEL THIS AGREEMENT WITHIN 10 BUSINESS DAYS FROM AND INCLUDING THE DAY AFTER YOU SIGNED OR RECEIVED THIS AGREEMENT.

DETAILS ABOUT YOUR ADDITIONAL RIGHTS TO CANCEL THIS AGREEMENT ARE SET OUT IN THE INFORMATION ATTACHED TO THIS AGREEMENT. PLEASE REFER TO THE ATTACHED CANCELLATION NOTICE FOR FURTHER DETAILS.

Congratulations on taking advantage of our exciting holiday package. This Agreement lists the terms and conditions of purchase for your Holidays by Wyndham Package purchased.

Your voucher is valid for 90 days from the date of purchase. Please refer to your electronic proof of purchase (receipt or holiday certificate confirmation e-mail) for date of purchase. Travel dates must be booked before voucher expiry and bookings can be made 60 days in advance.

Please be advised that non-attendance, failure to complete or failure to meet conditions for the sales presentation will result in forfeiture, a penalty charge of the full package price will automatically be charged to your credit card.

 

Terms of Agreement

Terms and Conditions
You, or if married, engaged or in a relationship and sharing residence, then both parties must attend and complete an informative sales presentation of approximately 90 minutes (whilst on your holiday).
  1. Qualifying Criteria
  • This offer is not available to groups (more than two affiliated couples)
  • It is designed for singles and couples who are married, engaged or in a relationship and sharing residence who:
    • If Single
      • have a minimum annual income of AUD$75,000 per annum (Australian residents) or NZD$75,000 per annum (New Zealand residents); and are
      •  between the ages of 25-72 years of age; or
    • If married, engaged or in a relationship and sharing residence
      • have a minimum combined annual income of AUD$90,000 per annum (Australian residents) or NZD$90,000 per annum (New Zealand residents); and are
      • between the ages of 25-72 years of age; or
    • If a Self-funded retiree
    • be between the ages of 65-72
  • Permanent residents of Australia or New Zealand.
  • Employees and their immediate families, existing WorldMark South Pacific Club Owners, existing Discovery by Wyndham members, and persons who have attended a presentation within the past twelve (12) months are not eligible to participate in this offer and claim rewards.
  • A Qualified Prospect can only ever receive a maximum of three (3) Packages over the course of their life.
  1. The Presentation
  • Holidays by Wyndham offers are provided at a discounted rate in return for compulsory attendance at and completion of the WorldMark South Pacific Club presentation.
  • Highlights the benefits of WorldMark South Pacific Club - an innovative, affordable, flexible timeshare ownership which is part of Wyndham Vacation Ownership, the world’s largest Vacation Ownership company enjoyed by over 900,000 Owner families worldwide.
  • At the presentation, you will be made an offer to purchase our product. However you are under no obligation to purchase anything.
  • Non-attendance and or failure to complete the sales presentation for any reason or circumstance will result in a breach of this Agreement and will incur a Penalty Charge being the full package price (including accommodation, flights and/or vouchers if applicable) (“Penalty Charge”) will automatically be charged to your credit card (less the cost of the relevant Holidays by Wyndham offer initially purchased).

  • Please note we are unable to accommodate children under the age of 12 years at our presentations.
  • Please ensure that you (and your partner) bring along your driver's licence or photo ID.
  1. General Rate Conditions
  • Full payment is required at the time of booking. Payment can be made by credit card (excluding American Express and Diners), money order or cheque. An additional 0.9% Credit Card Service Fee will be applied to all amounts paid by credit card.
  • Any deposits paid for packages or holiday offerings are non-refundable
  • Offers cannot be used in conjunction with any other Wyndham Destinations Asia Pacific offer and only one offer may be redeemed per household.
  • Offers subject to availability. All prices quoted in Australian Dollars (incl. GST).
  • Additional charges will apply for room upgrades and extra nights.
  • Additional food, beverages or services are not included in this offer (unless specified). A credit card imprint or cash deposit will be required at check-in for bond (this is refundable upon checkout).
  1. Package Rate Conditions
  • Unless otherwise stated, all prices are based on either a studio apartment/hotel room for two adults ( Port Macquarie, Sydney, Torquay, Ballarat, Port Douglas, Marcoola Beach, Melbourne and Dunsborough), a one-bedroom apartment for two adults (Seven Mile Beach, Coffs Harbour, Shoal Bay,Golden Beach and Wanaka) or a one-bedroom apartment for two adults and two children under 12 years (Kirra Beach, Surfers Paradise and Fiji).
  • The per room per night rate offer includes 2 or 3 nights’ accommodation as specified in package details.
  • Vouchers valid for 90 days, and bookings can be made 60 days in advance, up to the expiry date of the voucher.
  • Packages are non-refundable and cannot be transferred to another name. Space is limited and all reservations are subject to availability.
  • Seasonal surcharges apply depending on departure date
  • Holidays by Wyndham have the right to charge extra if the number of people is greater than what was confirmed upon the booking. If applicable, prices are inclusive of Australian, New Zealand & Fijian Airport Taxes, except taxes that can only be paid upon departure. Prices are quoted in Australian dollars unless otherwise specified, which are correct at time of publishing and subject to limited availability.
  • If applicable - Airline Tickets cannot be transferred to another name and will be considered as a cancellation. Travel dates cannot be changed under any circumstances and will be considered a cancellation, if unable to travel on dates stated on issued airline tickets.

  1. Voucher Promotions
  • For holiday packages where vouchers and/or discounted theme park tickets are offered, the full package price consists of the total cost of accommodation (refer to specific destination links found below) PLUS the full cost of theme park tickets and/or vouchers as issued to you (this cost is available to you upon request at the time of booking).
  • From time to time, you may be offered additional items to add to your holiday package, such as vouchers or gift cards at a discounted price. To receive such additional packaged items at a discounted price you must abide by these Terms and Conditions, and may be required to travel to specific destinations and on specific dates as listed in the specific offer.
  • Wyndham Destinations Asia Pacific is not affiliated with Coles Group and Myer and these companies have not endorsed this promotion or the products promoted by Wyndham Destinations Asia Pacific. Use of all Vouchers and/or Gift Cards will be subject to Terms and Conditions of use imposed by the Voucher or Gift Card fulfillers.
  1. Special Offer Packages Additional Terms and Conditions
RESORT VOUCHER OFFERS
  • Resort Voucher will be gifted upon completion of the Vacation Ownership presentation. If staying at a non-Wyndham property, the gift will be a Coles Group & Myer Gift Card to the same value. Valid for bookings and travel made by the specified period.
EXTRAS ON US OFFERS
  • For bookings and travel by the specified period. Attendance at a Vacation Ownership Presentation during the stay is a requirement of this promotion.  Non-attendance and or failure to complete the sales presentation for any reason or circumstance may result in forfeiture of this offer, and the full cost of the bonus gift recovered by Wyndham Destinations Asia Pacific.

  1. Penalty Charge Details
  • For the standard packages (accommodation only), the penalty charge is the full package price which consists of the total cost of accommodation. Please visit www.holidaysbywyndham.com.au/terms  to view the full rates for all properties.
  • For flight and accommodation offers, the penalty charge is the full package price which consists of the total cost of accommodation (please visit www.holidaysbywyndham.com.au/terms to view the full rates for all properties) PLUS the total cost of the actual flight(s) booked and travelled (this cost is available to you upon request at the time of booking).
  • For holiday packages including vouchers, the penalty charge is the full package price which consists of the total cost of accommodation (please click here to view the full rates for all properties) PLUS the total cost of the actual vouchers as issued to you (this cost is available to you upon request at the time of booking).
  • The penalty charge for the full package prices for Fiji and accommodation rates for other destinations, which includes room type and season, are provided at www.holidaysbywyndham.com.au/terms.
  • Please note, the penalty charge will differ depending on: which Holidays by Wyndham offer is selected; whether it is an accommodation only offer or a flight and accommodation offer; and whether the dates travelled fall in high or low season periods.
  • The penalty charges are based on standard packages. If any charges are made to the room, or if any upgrades or extras are taken, full charges and season rates will apply. All prices are quoted in Australian dollars and are inclusive of GST unless otherwise specified.
HIGH SEASON PERIODS
  • High and low season rates are not applicable to all destinations.

  1. Consent
All guests confirm that they authorise Wyndham Destinations Asia Pacific Pty Ltd to use their contact details (residential and email) and telephone number(s) (work, mobile and home/private) provided in this form for sales and marketing purposes, in particular, for the purpose of offering the opportunity to attend a timeshare sales presentation on the WorldMark South Pacific Vacation Ownership program, for an indefinite period until they opt out. To retract your express consent, contact Wyndham Destinations Asia Pacific Customer Service on 1800 021 130 or +61 7 5512 8040, or verbally request your retraction when speaking with a company representative at time of call.
  1. Cancellation Policy
If staying in a Wyndham property: Packages including any upgrade fees, additional nights or seasonal surcharges are non-refundable and cannot be transferred to another name. Rescheduling outside of 7 days from check-in will incur a $50 fee to be charged at the time of rescheduling. A maximum of 1 reschedules allowed per booking. Rescheduling or cancellations are not permitted within 7 days of check-in. A no-show on the check-in date and non-attendance or failure to complete the sales presentation, will incur a Penalty Charge being the full accommodation cost, which will be automatically charged to your credit card.
 
If staying in a non-Wyndham property: Cancellations of reservations and attempts to reschedule bookings made at Non-Wyndham properties are not permitted for any reason. Once confirmed a booking cannot be refunded or altered in any way and will incur the full accommodation price being automatically charged to your credit card.
  1. Health and Immigration
You should familiarise yourself with any health or visa requirements that may be applicable in the areas you intend visiting. You are responsible for all exit, entry, health and other documents required by laws, regulations, orders, demands or requirements of the countries visited or transited. Each person shall carry a valid passport at all times. Kindly note that passport and visa requirements are not our responsibility or that of your travel consultant and Travel by Wyndham is not liable for any loss or expense due to a passenger's failure to comply with the above. Travel insurance is highly recommended.
 
By purchasing a Holidays by Wyndham holiday voucher, I/we hereby acknowledge that I/we have read, understood and accept all Terms and Conditions and I/we authorise to being contacted by Wyndham Destinations Asia Pacific by phone, electronic messaging and post regarding promotional offers, products and services for an indefinite period or until I/We opt out.
